The aqua stat in note D maintains the temperature of the hot water in the loop, 24/7. It does not satisfy the code requirement to shut down the hot water loop during periods of no hot water demand. Typically a programmable timer is required to turn off the hot water recirculation pump and override the aqua stat so that hot water is not circulating in the system when not in use, such as in the middle of the night.
